The Federal Constitutional Court has dismissed the appeal by the AfD in Rhineland-Palatinate against a ruling by the Constitutional Court in Koblenz (case no.: 2BvR 686/25 of 24 June 2025). In 2024, former Minister President Malu Dreyer had called for demonstrations against the AfD via state government internet portals. The party saw this as a violation of the neutrality requirement and brought an action before the Constitutional Court - but without success.
This decision has now been upheld, although the Federal Constitutional Court did not deal with the content of Dreyer's duty of neutrality. It dismissed the case on procedural grounds and clarified that „according to the federal system of the Basic Law“, there is no second instance above the state constitutional courts.
