Local authorities should find it easier to fulfil the requirement for all-day care. On the initiative of several federal states, the Bundesrat decided on 13 June 2025 to introduce a corresponding bill (BR-Drucksache 208//25). The aim is to create the conditions for low-threshold youth work services in accordance with Section 11 SGB VIII to fulfil the future legal entitlement for children of primary school age during the school holidays.
According to the current legal situation, only services that are under school supervision, such as (open) all-day schools, or are run as day facilities with an operating licence in accordance with Section 45 SGB VIII, for example after-school care centres, fulfil the legal entitlement. The entitlement exists for eight hours a day on working days and, according to the explanatory memorandum to the federal government's draft law on all-day support for children of primary school age, also applies in principle during school holidays.
By adding a new sentence 4 to Section 24 Para. 4 SGB VIII in the version from 1 August 2026, the entitlement to all-day care could now also be fulfilled by youth work services in accordance with Section 11 SGB VIII. This is because there are currently numerous established and popular local services during the school holidays, but not all of them meet the legal requirements for fulfilling the legal entitlement. The planned amendment to the law is intended to give local youth welfare organisations the opportunity to ensure existing holiday offers that are in demand and also to guarantee fulfilment of the legal entitlement with a wide range of diverse youth work offers.
