BVerfG to rule on civil servant salaries in Rhineland-Palatinate

The Koblenz Administrative Court has referred two cases to the Federal Constitutional Court concerning the salaries of two firefighters. The Administrative Court wants to clarify whether their salaries were unconstitutional because they violated the minimum distance requirement in the period from 2012 to 2021 (Ref.: 5 K 686/22 and 5 K 1153/22 of 29 April 2024). According to this requirement, the salary must differ sufficiently clearly from the level of social benefits. In the cases in question, the net salary of the civil servants was less than 15 per cent above the level of social benefits. The court ruled that this was not enough.
