Our lawyer Anuschka Siegers emphasises that the introduction of a lottery procedure would constitute a serious encroachment on fundamental rights, for which a decision by the Federal Government would not be sufficient. Parliament itself, as legislator, would have to specify the selection criteria with sufficient certainty and, from a constitutional perspective, guarantee the principle of equality, legal protection options and the right to conscientious objection.
