The case of a police officer who was not dismissed from his job despite racist and anti-Semitic chats on his private mobile phone has caused a stir. The Administrative Court of Munich ruled that the private messages were protected by freedom of expression and personal rights. In the joint podcast by NJW and beck-aktuell „Gerechtigkeit & Loseblatt“, Rechtsanwalt Dr Stephan Berndt gives a legal assessment of the decision and also addresses the challenges faced by employers when dealing with conspicuous civil servants.
