Applying for funding for local authority investments is a rocky road. This makes it all the more gratifying when the funding is granted. Naturally, one then wants to be „allowed to keep“ it:

One aspect of the audit of the statement of expenditure is the verification that contracts have been awarded in accordance with the rules. This concerns the commissioning of architects and specialist planners, or the awarding of construction contracts for the new nursery, school or road. If the funding body identifies any breaches of procurement rules, this may result in the partial or even complete withdrawal of funding, depending on the severity of the breach.

The aim of the seminar is to explain to participants the specific aspects of public procurement law relating to funded projects, and to highlight typical mistakes and ways of avoiding them. The conditions under which funding may be withdrawn will be discussed.

The seminar is rounded off with an explanation of the legal remedies available and how to deal with the funding body.

Janko Geßner is a specialist lawyer in administrative law and a founding partner of DOMBERT Rechtsanwälte. He heads the „Public Contracts and Procurement” practice group. He holds a lecturing post on public procurement law at the Brandenburg University of Technology (BTU) Cottbus-Senftenberg.
