Tesla's authorisation procedure in Brandenburg is currently a very good illustration of the tension between investment interests and the legal framework for emission control. The factory to the east of Berlin is up and running and is producing its first vehicles, although the final authorisation has not yet been granted. Instead, the responsible licensing authority has issued almost twenty (!) individual notices of early commencement - probably a unique occurrence. However, this is just one example of the numerous legal issues in connection with immission control law.
Neither the licensing authorities nor the applicant like to hear the phrase „See you in court!„. The environmental impact of facilities is prone to disputes both for their operators and for affected neighbours. This is evident both in (formal) approval procedures and in the „defence“ of approvals against third parties who - for their part - want to achieve an effective defence against immissions. And if the permit first has to be appealed or is contested by neighbours or environmental associations, it usually takes years before legal certainty prevails.
In order to conduct a successful and legally compliant immission control approval procedure, various obstacles must be recognised and overcome at an early stage. In our webinar, we will therefore present the system and the key principles of the authorisation and monitoring of emitting installations and go into more detail using current practical cases. You will learn which „stations“ are particularly important in the authorisation procedure. In material terms, we will look at the authorisation requirements and the relevant regulations, as well as the responsibilities and obligations of plant operators and the possible rights of third parties and environmental associations to take legal action.
