The seminar builds on the basic seminar „Public procurement law - sub-threshold awards“. The aim of this seminar is to deal with individual aspects of sub-threshold awards in greater depth.
 

The advanced seminar is aimed at employees of municipal contracting authorities in Brandenburg who already have in-depth basic knowledge of public procurement law and would like to further develop their confidence in day-to-day procurement practice. The focus is on the legally compliant implementation of award procedures in the sub-threshold area, taking into account the Sub-Threshold Procurement Regulations (UVgO), the Procurement and Contract Regulations for Construction Services Part A (VOB/A) and the relevant state law requirements in Brandenburg.
Practice shows that the requirements for award procedures in the sub-threshold area are increasingly orientated towards the general principles developed in public procurement law and current case law. Municipal contracting authorities are therefore also confronted with complex issues below the thresholds that require in-depth legal categorisation and practical solutions. The seminar addresses this development and highlights the standards to be applied in the preparation, implementation and documentation of procurement procedures.
In the first part of the seminar, the central phases of a procurement procedure are dealt with in depth on the basis of the UVgO. The focus is less on an overview and more on typical problem constellations from municipal practice, such as choosing the right type of procedure, the legally compliant definition and review of suitability and award criteria, dealing with supplementary claims and clarifications as well as communication with bidders.
The second part of the seminar is dedicated to the awarding of construction services in accordance with VOB/A in the sub-threshold area. In particular, the special features of the awarding of construction contracts, the differentiation between the types of procedure, typical sources of error in the description and evaluation of services and the handling of supplements and changes to tenders will be dealt with. Practical case studies are also used here to highlight legal risks and provide concrete recommendations for action.
The aim of the seminar is to provide participants with in-depth knowledge and practical security for the implementation of supply, service and construction contracts in the sub-threshold area and to enable them to implement award procedures in a legally secure, efficient and comprehensible manner.

The brains behind the event.

Philipp Buslowicz,LL.M.

has already been working as a lecturer for the Brandenburg Municipal Academy for several years. He has been employed as Rechtsanwalt at the law firm Dombert Rechtsanwälte since 2020 and has been a specialist lawyer for public procurement law there since 2022. His core areas of expertise are public contracts and procurement as well as planning, construction and infrastructure projects.
