Applying for funding for municipal investments is a rocky road. This makes it all the more gratifying when the funding is granted. People then want to be able to „keep it“. But there are sometimes „pitfalls“ lurking...

What is it about?

One component of the verification of where-used lists is the examination of the proper awarding of contracts. This involves the commissioning of architects and specialist planners or the awarding of construction contracts, e.g. for the new day care centre, school or road. If the funding provider identifies breaches in the awarding of contracts, there is a risk of partial or even complete cancellation of funding, depending on the severity of the breach.

The aim of the seminar is to explain to participants the special features of subsidised projects under public procurement law and to point out typical mistakes and ways to avoid them. The requirements for the cancellation of subsidies will be discussed. The seminar is rounded off with explanations of the legal protection options and the correct behaviour towards the funding provider.

Focal points:

  • Applicable procurement law for subsidised projects
  • Special features under state law for ancillary provisions under public procurement law
  • Typical procurement errors and how to avoid them
  • Penalty list of the funding body: Classification of award violations
  • Cancellation: Requirements and legal protection options
  • Golden rules for dealing with the funding organisation
  • Liability of managing directors and other executive bodies in the event of revocation
