Content of the event

The seminar presents the legal requirements for the cancellation of grant notifications in accordance with Sections 48 and 14 VwVfG. Both the factual requirements and the legal consequences such as reimbursement and interest are discussed. The seminar is rounded off with explanations on procedural and litigation issues - such as typical legal action constellations or settlements.

What is it about?

Even if funding recipients and granting authorities would like to avoid it, it is not uncommon for funding decisions to be cancelled. There are many reasons for this, ranging from errors in the approval process and breaches of conditions to the improper use of funds.

The seminar deals with the factual requirements for the cancellation of grant notifications as well as the legal consequences of cancellation - reimbursement and interest. Questions of the cancellation procedure and the relevant cancellation deadlines are discussed as well as requirements for the discretion to be exercised. The seminar presents the typical procedural constellations and provides information on how to avoid or settle legal disputes by means of a settlement.

Focal points:

  • Cancellation of grant notices in accordance with Sections 48, 49 VwVfG
  • Formal and material requirements for cancellation
  • Legal consequences of cancellation, in particular reimbursement and interest
  • Legal protection against cancellation
  • Comparative avoidance and settlement of legal disputes
