Legal action against incorrect tariff categorisation by BG Bau

70 companies are currently taking legal action against the current tariffs of the Berufsgenossenschaft Bau (BG Bau). The background to this are tariff changes that have led to some drastic increases in contributions - the industry is expecting an additional burden of around €100 million. The trigger is the categorisation of manufacturers of prefabricated timber houses in the same tariff category as carpentry companies - even though their accident risks „in the open air“ are significantly higher than in production in factory halls.

 

The first courts have followed the arguments of the companies and their lawyers and have cancelled contested contribution notices. The mandates for DOMBERT Rechtsanwälte are Prof Dr Matthias Dombert and Rechtsanwalt Philipp Korbmacher, LL.M.

 

„The amalgamation of our clients with carpentry companies is incomprehensible. Apples were compared with pears without taking into account the sector-specific characteristics. The result is economically drastic premium increases. Our clients do not have to accept this, as six court rulings have now established.“
