The new State Procurement Act (ThürVgG) has been in force in Thuringia since 1 January 2024. It stipulates a dynamic minimum wage and increased value limits.
Local authorities may now award contracts directly with a contract value of up to 7,000 euros. Contracts for supplies and services may be awarded by negotiation up to a contract value of 50,000 euros. Direct award of contracts for construction services is permitted up to a value of 250,000 euros. A restricted invitation to tender without a call for competition is permitted for supply and service contracts up to a value of 100,000 euros and for construction services up to a value of 500,000 euros. It should be noted that these value limits are lower limits. The Ministry of Economic Affairs, as the regulator, may deviate from these upper limits.
The minimum wage for awarding contracts is initially set at 13.91 euros gross per hour. It should always be 1.50 euros above the statutory minimum wage.
