Episode 1 - Mayoral elections and their contestation
Mayors are directly elected by the people - and that is precisely why so much is at stake when an election is contested. Maximilian Dombert and Dominik Lück take the case in Strausberg as an opportunity to explain the municipal electoral review procedure from the ground up: Who may lodge an objection and when? What requirements does case law set and why do so many objections fail due to the burden of substantiation?
A central problem: in the end, it is often the municipal council that decides on the validity of an election - a body that is itself politically appointed and has emerged from elections. The two lawyers discuss whether this is still up to date and what state legislators should learn from this.
