Prefabricated timber construction companies successfully sue before the Freiburg Social Court

In several proceedings, the Social Court of Freiburg has declared the hazard tariff of the Employer's Liability Insurance Association for the Construction Industry (BG Bau), which has applied to prefabricated timber construction companies since 2024, to be unlawful. Industrial prefabricated timber construction companies could not be treated in the same way as carpentry companies. The judges agreed with the arguments of the law firms DOMBERT Rechtsanwälte and the VOELKER law firm and partners from Reutlingen, representing a total of 60 companies: Due to the industrial production method and the low accident risks, prefabricated timber construction companies and carpentry companies working by hand must be considered and assessed separately. With its decision, the Freiburg Social Court follows the line of the Würzburg Social Court, which had already ruled in favour of several prefabricated house manufacturers at the beginning of September 2025.

In total, more than 70 companies across Germany have filed a lawsuit against the BG Bau's 4th hazard tariff, the introduction of which has led to considerable additional financial burdens - the industry estimates around €100 million.
