How the expansion of renewable energies will continue after the general election was the hotly debated topic at the „Hasewind Stammtisch“ on 31 March 2025 in Osnabrück. For the first time, the „Right to Energy Forum“ took place before the regulars' table and was attended by around 70 players from the wind energy sector. Rechtsanwalt Tobias Ross provided information on initial legal assessments of the exploratory results, explained current problems from authorisation practice in North Rhine-Westphalia and Lower Saxony and also outlined possible solutions. Roß also addressed the new challenges that the planned abolition of procedural simplifications in wind energy areas (Section 6 WindBG) and new requirements regarding noise immissions for the authorisation of wind turbines in accordance with the Federal Immission Control Act (Section 9 (1a) BImSchG) will pose in practice. Lawyer Josefine Wilke explained how suitable areas for ground-mounted photovoltaic systems can be found more easily using criteria catalogues and how the usage contracts for these systems can be structured in a legally secure manner.
