School may ban internships with AfD members of parliament

A school may prohibit pupils from completing a school internship with an AfD member of the Bundestag. This has now been decided by the Higher Administrative Court (OVG) of Berlin-Brandenburg (Ref.: 3 S 5/26 of 16 January 2026). It dismissed the appeal of a pupil who attended a vocational grammar school in Brandenburg and confirmed the decision of the administrative court in Frankfurt (Oder).

 

The OVG justified its decision by stating that a school internship is a school event outside of the classroom. As part of its educational mandate, the school therefore also has a wide range of pedagogical leeway in terms of the content and organisation of the internship. As the AfD in Brandenburg has been categorised by the State Office for the Protection of the Constitution as definitely right-wing extremist, the school did not overstep these boundaries when it prohibited the internship. The member of the Bundestag is a member of the board of the state association.
