The electoral review complaint regarding the state election of 1 September 2024 remains unsuccessful. This was decided by the Thuringian Constitutional Court (Constitutional Court) (Ref.: 26/25 of 29 April 2026). The background to the decision is a text entitled „Media information“, which was printed on the letterhead of the press office and sent out shortly before the election. It warns against the AfD and the BSW. The text was signed by 17 district councillors and mayors.
The plaintiffs saw this as unauthorised official influence and a violation of the neutrality requirement. The Constitutional Court agreed: the „media information“ violated the requirement of party-political neutrality of the state in the election campaign. This also constituted an electoral error in the sense of an objective violation of electoral law. However, this does not lead to the election being invalid, as this electoral error is not relevant to the mandate. This is only ever the case if it can have an influence on the distribution of seats in parliament. However, according to the Constitutional Court, this concrete possibility, which is to be assessed according to general life experience, was lacking in this case.
