Teacher has to commute to new school

A teacher must accept a transfer to another school due to staff shortages. This was decided by the Gelsenkirchen Administrative Court (Ref.: 1 K 6161/25 of 30.04.2026). The court also found that the longer commute of around 35 kilometres was reasonable. The teacher's appeal was therefore unsuccessful. The court argued that the public interest in teaching without cancellations due to staff shortages should be considered more important than the individual interests of the civil servant. Only significant interests of the civil servant or deployment to an unreasonable location would speak against a transfer. However, this was not the case here. As a state civil servant, the teacher must therefore expect to be deployed anywhere in the state if the employer so wishes.
