The „Act to Accelerate Housing Construction and Secure Housing“, also known as the „Construction Turbo“, came into force on 30 October 2025. It is intended to help simplify the construction of flats and Procedure to be accelerated. Several amendments were made to the German Building Code (BauGB) for this purpose. They include exemptions from existing development plans (Section 31 (3) BauGB) and deviations from the existing townscape (Section 34 (3b) BauGB) as well as from other provisions of the BauGB (Section 246e BauGB) in order to create new living space - whether through new construction, redensification or conversion. However, the prerequisite is that the respective municipality gives the green light for the exemption or deviation. In outdoor areas, the new Section 246e BauGB should also only apply to properties that are closely connected to existing buildings in order to avoid urban sprawl.

 „As with every amendment to building law, the construction turbo will also depend on the practical use of the opportunities granted by the legislator,“ says Rechtsanwalt Dr Maximilian Dombert. „Building permit authorities and municipalities should therefore utilise the opportunities offered by the new regulations in the interests of urgently needed housing construction.“
