Many supermarkets provide their customers with large plastic bags to carry their shopping. The Federal Administrative Court has now ruled (Case No. 10 C 6.25 of 23 July 2026) that shops must also participate in the Dual System for the collection of packaging under waste legislation in respect of these more durable bags. Carrier bags that are designed and intended to be used by the end consumer to carry purchased goods are packaging subject to the system, regardless of their material and durability, according to the court’s press release. This applies even if end consumers also use the bags for other purposes.
„The decision affects numerous companies across various sectors, but it also provides clarity regarding the obligation for companies offering reusable carrier bags to join the scheme,“ says lawyer Izabela Bochno.
