The amendment to the Federal Immission Control Act (BImSchG) came into force on 9 July 2024. The aim of the amendment is to accelerate the expansion of wind energy. Streamlining and reducing bureaucracy in the approval process are planned to achieve this. For example, approval deadlines may only be extended once, documents that are not directly relevant to the approval process may be submitted later and repowering, i.e. the replacement of existing wind turbines with new, more powerful turbines, is also to be simplified. However, not only wind energy project developers should benefit from the simplified authorisation procedures, but also anyone who wants to erect or expand an industrial plant in Germany. „The new regulations are very welcome. In the end, however, it will be up to official practice and, not least, adequate staffing levels to determine whether the new German speed in the approval of plants is achieved,“ says Rechtsanwalt Tobias Roß.
