Monument Protection and Cultural Heritage Law

Preserving cultural heritage while enabling its modern-day use – we develop legally sound solutions to achieve both objectives.

Our expertise includes building and garden monument law, the protection of historic ensembles and monument areas, as well as the law governing archaeological monuments.

The protection of architectural and archaeological monuments presents owners, authorities and project organisers with complex legal challenges. We advise Monument owners and monument authorities at the Protection, at Maintenance and refurbishment measures and - as a last resort - in the legally secure enforcement of claims for the removal of monuments.

A particular focus of our practice lies in projects carried out in the vicinity of protected monuments. Construction and infrastructure projects frequently give rise to conflicts in this context, as unexpected heritage-related approvals and permits may become necessary. We help identify risks at an early stage and develop practical, workable solutions. We also regularly contribute our expertise to discussions on legal policy and heritage conservation.

Furthermore, we support museums, foundations and other public and private cultural institutions in all matters relating to cultural law – from organisation and financing to the handling of sensitive cultural assets.
