The Saxon Higher Administrative Court has provisionally categorised Christopher Street Day Dresden as an assembly in summary proceedings (Decision of 2 June 2026 - 5 B 142/26).
This was preceded by a dispute as to whether the street festival at Christopher Street Day in Dresden was also protected as an assembly within the meaning of Article 8(1) of the Basic Law. The State Directorate of Saxony had denied this, as the street festival was primarily aimed at entertainment and not at forming political opinions. This would therefore not constitute an assembly. The Dresden Administrative Court initially confirmed this.
After the organiser had expanded the event concept of the street festival in the meantime, the Higher Administrative Court of Saxony has now ordered in summary proceedings that the event is to be classified as an assembly for the time being. In doing so, it left open the question of whether the event actually constituted an assembly and weighed up the interests involved. In particular, it took into account the risk that otherwise the majority of the registered assembly could not take place or could not take place as planned. Freedom of assembly is of great importance.
